By downloading or using the app you accept them. If you do not, please do not use the app. ## Licence xMosaique is provided free of charge. You get a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control. On Apple devices that licence also runs under Apple's [Licensed Application End User Licence Agreement](https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) and the App Store Terms of Service; on Android it runs under the Google Play Terms of Service. You may not reverse-engineer, decompile, or disassemble the app, remove or obscure any notices in it, or redistribute, sell, or sublicense it — except where that restriction is not permitted by law. ## Your photos are yours Everything you shoot with xMosaique belongs to you. The app claims no rights over your photos, your presets, or anything else you create with it. The developer never receives them — capture and processing happen on your device, as described in the [Privacy Policy](/privacy-policy/). You are responsible for what you photograph, including obtaining consent and following the laws about photography where you are. ## Presets Preset files you import remain subject to whatever licence they came with. Some Lightroom and Camera Raw presets are sold or licensed with restrictions, and it is up to you to hold the rights to the presets you use. The looks bundled with xMosaique may be used freely in your own photography. ## Availability The app is provided as it is, and features may be added, changed, or removed between versions. There is no guarantee that any particular feature, camera capability, or preset behaviour will remain available, and iOS or hardware changes outside our control may affect how it works. ## Trademarks Adobe, Lightroom, Camera Raw, and Photoshop are trademarks of Adobe Inc. Apple, iPhone, iOS, ProRAW, and App Store are trademarks of Apple Inc. Android, Google Play, and Google Drive are trademarks of Google LLC, and OneDrive is a trademark of Microsoft Corporation. xMosaique is not affiliated with, endorsed by, or sponsored by any of them. Those names are used only to describe compatibility. ## Disclaimer of warranties The app is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. It is not guaranteed to be uninterrupted, error-free, or free of defects. Photography is unforgiving: keep your own backups. No guarantee is made that any given capture will be written, retained, or recoverable. ## Limitation of liability To the fullest extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of photographs, data, profits, or opportunity, arising from your use of or inability to use the app — even if advised that such damages were possible. Where liability cannot be excluded by law, it is limited to the amount you paid for the app, which is nothing. Nothing in these terms limits any statutory consumer rights you have that cannot be waived. ## Apple Apple is not a party to these terms and has no obligation to provide support for xMosaique. Apple is a third-party beneficiary of these terms and may enforce them against you. Any claim about the app not conforming to a warranty is a matter between you and the developer, not Apple. ## Governing law These terms are governed by the laws of the jurisdiction in which the developer is established, without regard to its conflict-of-law rules. Any dispute will be brought in the courts of that jurisdiction, except where mandatory local consumer law entitles you to bring it elsewhere. ## Changes These terms may be updated from time to time. The current version always lives on this page, with the date it took effect at the top.
